TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of charlottes-atelier.com (the “Site”) and your purchase of products from Charlotte’s Atelier (“we”, “us”, “our”). By accessing the Site or placing an order, you agree to these Terms.

1. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You must not attempt to interfere with the Site’s security, scrape the Site, or use it for fraudulent or misleading activity.

2. Products & Availability
Product details (including images, materials, dimensions, and care) are shown on the product pages. We try to display colors and details accurately but cannot guarantee that your device’s display is exact. We may change or discontinue products at any time.

3. Pricing & Currency
All prices are displayed in USD. Shipping fees (if any) are shown at checkout or described on our Shipping page. Promotional pricing may be time-limited and subject to conditions.

4. Orders & Payment
Placing an order is an offer to buy. We may accept or decline any order (e.g., where a product is out of stock, there is an error in pricing or description, or we suspect fraud). Payment is processed by our payment service provider; you authorize them to charge your selected payment method for the total amount at checkout. We may request additional verification before accepting an order.

5. Shipping & Delivery
Processing time: We prepare orders within 1–2 business days (Mon–Sat).
Delivery timeframe: Once dispatched, deliveries typically arrive within 5–11 business days (Mon–Sat).
Delivery speeds can vary due to carrier capacity, peak seasons, public holidays, customs/security checks, or other factors outside our control. For current details, see our Shipping Information page. You’ll receive a tracking link by email once your parcel is on its way. Title and risk in the products pass to you upon delivery to the address you provide.

6. Returns, Exchanges & Refunds
We want you to be happy with your purchase. Our full policy is set out on the Returns & Exchanges page and forms part of these Terms. Key points:

  • Change of mind: You may start a return within 30 days of delivery, provided items are unused, in original condition and packaging. Return postage for change-of-mind returns is not covered by us.

  • How to start: Email support@charlottes-atelier.com with your order number and reason. We’ll reply with a simple confirmation email that includes clear return instructions and the return address.

  • Where to send: All returns are sent to our returns warehouse in China. The full address is provided in our confirmation email. Returns sent without waiting for that email may be delayed or refused.

  • Exchanges & faulty items: If your item arrives damaged, defective, or not as described, contact us within 7 days with photos. We will arrange a replacement or refund and cover reasonable return postage once assessed.

Nothing in these Terms limits any rights you may have under applicable consumer laws (including U.S. state and federal consumer protection laws).

7. Cancellations
You may request cancellation within 1 hour of purchase if your order has not yet been processed. Please email support@charlottes-atelier.com promptly with your order number.

8. Prohibited Conduct
You must not use the Site to: (a) engage in illegal activity; (b) infringe intellectual property or privacy rights; (c) harass, defame, or harm others; (d) transmit malware or spam; (e) attempt to gain unauthorized access to our systems.

9. Intellectual Property
All content on the Site—including text, graphics, logos, images, and code—is owned by or licensed to us and protected by intellectual property laws. 10. User Content (Reviews, Photos, Comments)
If you submit reviews or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Site and our business (including for marketing), in any media, with or without attribution, consistent with applicable laws. You are responsible for the content you submit and must have the rights to share it.

11. Third-Party Services
The Site may link to third-party websites or services (e.g., payment gateways, carriers). We are not responsible for their content or practices. Your use of third-party services is at your own risk and subject to their terms and policies.

12. Warranties & Disclaimers
To the maximum extent permitted by law, the Site and products are provided “as is” and “as available”. We disclaim all warranties, express or implied, regarding the Site’s operation or the information, content, or materials included on the Site. This clause does not limit any non-excludable guarantees or rights you have under applicable consumer laws.

13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or revenue, arising from your use of the Site or purchase of products. Our aggregate liability for any claim is limited to the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, or limits your rights under applicable consumer laws.

14. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.

15. Governing Law & Jurisdiction
These Terms are governed by the laws of the United States (Delaware law). You agree to submit to the exclusive jurisdiction of the courts of Delaware, without prejudice to any mandatory rights you may have under consumer laws in your state of residence.

16. Changes to the Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Changes apply from publication on the Site. If you continue to use the Site after changes take effect, you agree to the updated Terms.
